REGULATIONS OF THE K&K ART GALLERY ONLINE GALLERY
(sale and auctions of artworks)
FOR ARTISTS
An artist using the services of K&K Art Gallery accepts the provisions of these Regulations and undertakes to comply with all the provisions contained herein.
§1. General provisions
The online store, hereinafter referred to as the "Gallery", is owned by Łafra Sp. Z o.o located in Warsaw (00-238) at Długa St. 29. NIP 5253038656, Regon 541152308.

- These Regulations define the rules of cooperation between the online store - the Gallery (hereinafter referred to as the "Gallery") and artists, collectors, or other entities authorized to submit artworks (hereinafter referred to as the "Artist").
- The Gallery provides the following services to the Artist:
a) providing space in the Gallery's sales catalogs,
b) providing space in the Gallery's auction catalogs,
b) presentation and promotion of artworks in the online space,
c) organizing online auctions,
d) selling artworks,
e) transaction handling and customer contact.
- The Gallery acts as an intermediary for the sale and auction of artworks.
- Each artwork presented on the Gallery's website has a certificate of authenticity.
- The Gallery does not acquire ownership rights to the artworks unless the parties agree otherwise in a separate agreement.
- The Gallery is not responsible for hidden physical defects of the artwork, as well as for its legal defects.
§2. Entities authorized to submit artworks
- The Gallery accepts artworks from:
a) professional artists,
b) in special cases, non-professional artists,
c) art collectors.
d) authorized owners of artworks
- Each submitted artwork must:
a) be free from legal defects,
b) not infringe copyright or the rights of third parties,
c) be free from significant physical defects,
d) remain at the disposal of the submitter throughout the exhibition and sale period.

§3. Artist registration and profile verification
- The condition for starting cooperation with the Gallery is the preliminary registration of the Artist.
- Registration is done by filling out the application form, to which the following must be attached:
a) a short biographical note,
b) portfolio (several sample works).
- Works submitted at the registration stage are solely for verification of the artistic work andare not automatically published in the Gallery's offer.
- The Gallery team verifies the application within 5 business days.
- In case of acceptance, the Artist receives the Regulations and further instructions via email.
- Failure to accept the application does not create any obligations for the Gallery.
§4. Submitting artworks to sales catalogs
- Upon acceptance of the Artist's portfolio, the Gallery begins handling the Artist's profile and their sales catalog of works.
- To add a work to the Gallery's offer, the Artist must fill out the "Add Work" form which includes the following information:
a) title of the work,
b) technique used,
c) dimensions,
d) year of creation,
e) author's price,
f) availability status.
g) add high-quality photos (for sculptures/objects, photos of works on a white background or no background)
- The work, once saved as "active", becomes available in the Gallery's catalog within 3 business days.
§5. Submitting artworks to auction catalogs
- Artworks submitted for auction require a separate submission.
- The Artist is obliged to sendat least three proposals of works to the specified email address of the Gallery.

- The total size of attachments must not exceed 10 MB.
- The Gallery reserves the right to select works for auction.
- Submitting a work for auction is equivalent to agreeing to its exhibition and the auction conditions specified in the Regulations.
- Information about the selected works for the Auction, the Artist sends in a separate form, which includes:
1. Title and Auction No.
a) title of the work,
b) technique used,
c) dimensions, weight
d) year of creation,
e) author's price,
f) adding high-quality photos (for sculptures/objects, photos of works on a white background or no background)
- Selected works/Art will appear in the Auction Catalogs of the Gallery and in catalogs for off-auction sales for a period of 60 days after the Auction ends (upon payment by the Artist and accounting by the Gallery of the operational cost, each time for the work/Art in the amount of 35 PLN + VAT).
§7. Financial Conditions
- For the sale of the artwork/Work, the Gallery chargesa margin of 30% + VATof the sale price.
- For providing space in the sales catalogs, the Gallery charges an operational monthly fee of3 PLN + VATper artwork.
- For providing space in the auction catalogs, the Gallery charges an operational fee of35 PLN + VATper artwork.
- For the sale of artwork/Work at the art Auction, the Gallery chargesa margin of 30% + VAT from the buyer and15% + VAT from the Artist, from the sale price.
- The author's price is set by the Artist and includes the applicable income tax, which is the Artist's responsibility to settle.
- The Gallery reserves the right to negotiate the price with the client within a margin of up to 10% down.
- The Gallery issues monthly collective VAT invoices.
§8. Settlements and Payments
- Funds from the sale of the artwork from the Gallery are transferred to the Artist's bank account specified during registration.
- Payment occurs by the 14th day of the month following the month of sale.
- Payment occurs after the statutory period for possible return of the artwork by the client.
§9. Deposit and Duration of the Agreement
- Submitting a work to the sales catalogs (offer) of the Gallery is equivalent to entering into a deposit agreement for a period of 6 months, with the possibility of extension.
- Submitting a work to the auction and off-auction catalogs (offer) of the Gallery is equivalent to entering into a deposit agreement for a period of 60 days with the possibility of extension.
- Each party has the right to withdraw the work from the offer with a 10-day notice period.
- The Gallery does not reserve the right of exclusivity for the sale of works.
§10. Copyright and Intellectual Property
- The Artist declares that they hold full copyright to the submitted works.
- The Artist grants the Gallery a free license to present the works for sales and promotional purposes.
- All content published in the Gallery is subject to legal protection.
§11. Personal Data
- The personal data of Artists is processed in accordance with applicable legal regulations.
- Data is stored in a secured and encrypted form.
- The Artist has the right to access, correct, and delete their data.
§12. Final Provisions
- The Gallery reserves the right to change the Regulations.
- In matters not regulated, Polish law applies.
- Disputes will be resolved primarily amicably.
- The regulations come into effect upon publication.
